District Judge Patti B. Saris: ELECTRONIC ORDER entered re 1 PETITION for Writ of Habeas Corpus (2241).Petitioner Auriel Silverio Junior ("Petitioner") has filed a habeas petition under 28 U.S.C. § 2241 seeking an order requiring the government to provide him with a bond hearing in immigration court. The government agrees with Petitioner that he is detained under 8 U.S.C. § 1226(a) and, thus, is entitled to a bond hearing. Under these circumstances, Petitioner must exhaust administrative remedies before pursuing habeas relief. See, e.g., Dos Santos v. Moniz, No. 26-cv-11978-ADB, Dkt. 8 (D. Mass. May 12, 2026) (requiring administrative exhaustion where there was no dispute the petitioner was eligible for a bond hearing); Harrar v. Moniz, No. 26-cv-11340-NMG, Dkt. 8 at 1-2 (D. Mass. Apr. 6, 2026) (same); Reyes Vargas v. Moniz, No. 26-cv-11320-MJJ, Dkt. 10 (D. Mass. Mar. 25, 2026) (same). The petition does not indicate that Petitioner has requested a bond hearing from the immigration court.
