MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 6/11/2026.Yesterday, Respondents filed an emergency motion for leave to transfer Petitioner beyond this judicial district. See generally Mot. for Leave to Transfer, ECF No. 6 . Through it, Respondents claim that Ms. Romero-Perez requires specialized emergency care which is unavailable within the State of Nevada. See id. Having reviewed Respondents' Motion, the Court established an expedited briefing timeline, which required Petitioner to expeditiously respond to the Motion. See generally Min. Order, ECF No. 7 (June 10, 2026). In turn, Petitioner promptly opposed the Motion, arguing that Respondents failed to properly support their allegations regarding Petitioner's medical needs. See Pet'r's Resp. 2, ECF No. 8 (June 10, 2026). In light of this opposition, and Respondents' history of problematic conduct before this Court, see Portillo v. Blanche, No. 2:26-cv-01373-RFB-MDC, 2026 WL 1493876, at *7 n.3 (D. Nev. May 28, 2026) (collecting examples of Respondents' systemic misconduct before this Court), the Court finds that it requires additional information to properly dispose of Respondents' Motion.Therefore, IT IS HEREBY ORDERED Respondents have up to, and including, June 11, 2026, to file a reply in support of their motion. To the extent Respondents have any records which support the allegations within their motion, they must FILE these records alongside their reply. See Rule 7, Rules Governing Section 2254 Cases in the United States District Courts ("If the petition is not dismissed, the judge may direct the parties to expand the record by submitting additional materials relating to the petition."); id. at Rule 1(b) (enabling a court to apply these rules to petitions brought under 28 U.S.C. § 2241). In doing so, Respondents must preliminarily file any records which reflect sensitive information under seal.IT IS FURTHER ORDERED Petitioner's Counsel must file a status report regarding Ms. Romero-Perez's medical needs after their imminent meeting.
