Judge Richard G. Stearns: ELECTRONIC ORDER entered re 8 Response to Petition for Writ of Habeas Corpus - 2241 filed by Markwayne Mullin, David Wesling, David Venturella, Antone Moniz. Petitioner Alvaro Eduardo, a citizen of Angola, is fifty-three years old and entered the United State on December 11, 2022. The Department of Homeland Security (DHS) granted Eduardo parole pursuant to 8 U.S.C. § 1182(d)(5) after determining that he was not a flight risk or a danger to the community. He has a pending asylum petition, obtained work authorization, and has never been arrested or convicted of a crime. Immigration and Customs Enforcement (ICE) took him into custody in May and has detained him at the Plymouth County Correctional Facility in Plymouth, Massachusetts.The court agrees with petitioner that he is entitled to a bond hearing. The government must arrange a bond hearing for Alvaro Eduardo before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Monday, June 15, 2026. (MZ) (Entered: 06/09/2026)
