Text of Order: The court construes Petitioners motion to withdraw notice of voluntary dismissal (doc. no. 5), as a motion to reopen this matter, see Fed. R. Civ. P. 59, 60(b). That motion to reopen is GRANTED, on the basis of new evidence showing that Petitioner is in ICE custody in New Hampshire or Massachusetts at this time. Petitioner is granted leave on or before June 1, 2026, to file either: (1) a motion to transfer this matter, see 28 U.S.C. § 1404(a), accompanied by an Amended Petition naming the proper Respondents in this case at that time, dropping any Respondent who is no longer Petitioner's custodian; or (2) a motion requesting a case management conference in this case, to be scheduled by this court. The Federal Respondents deadline for filing a response to the Petition is continued pending further court order.
