District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. This morning, Jackson Mayaguari Palta filed a petition seeking his release from custody alleging he is held in violation of the laws of the United States. Doc. No. 1. The Court ordered the respondents to respond by the close of business tomorrow. Doc. No. 4. It did so for several reasons. Liberty interests are at stake. This is one of myriad habeas petitions filed in this Court in the past few months by noncitizens in immigration detention after having lived in the United States for years. Many of these petitions raise the same or virtually the same dispositive legal issue. The government’s position has been widely if not uniformly rejected by judges in this District. Wisely, in cases raising such claims, the government now files a short response. Upon initial review of Mayaguari Palta’s petition, the Court noted that this matter was familiar to the government, as this petitioner’s claim was filed as part of a multi-party petition filed more than two weeks ago and assigned to Judge Stearns, who recently dismissed the action without prejudice on the ground that habeas petitions must be filed individually. See Alcantara Lugo v. Hyde, No. 25-cv-13296-RGS (D. Mass. filed Nov. 5, 2025). For all those reasons, the Court established a one-day response deadline. Soon thereafter, the duty AUSA contacted the Clerk to inquire about whether the one-day deadline was correct. On further review of the docket following this inquiry, the Court noted that the government took the position in the predecessor case before Judge Stearns that this petitioner’s claim differed materially from those cases in which the government files a short response, leading to the severance of this petitioner’s claim from those of most of his co-petitioners. In light of that fact, the Court hereby EXTENDS the government’s answer deadline in this case to Monday, November 24, 2025.(SED) (Entered: 11/20/2025)
