District Judge Angel Kelley: ELECTRONIC ORDER entered. On February 10, 2026, this Court granted Petitioner’s Habeas Petition and ordered Respondents to grant Petitioner a new bond hearing, during which the Government must show that alternatives to detention are inadequate. [Dkt. 12]. On February 20, 2026, Respondents provided a Status Report indicating that Petitioner had a bond hearing and was denied bond. [Dkt. 13]. The order denying bond states that the Immigration Judge found that “alternatives to detention would be appropriate.” [Dkt. 13-1 at 1 (emphasis added)]. As the order ultimately denies bond, the Court construes this to be a clerical error, and that the order should say that the Immigration Judge found that alternatives would be inappropriate.Absent objection regarding the Court’s construction of the Immigration Judge’s order within the next seven (7) calendar days, the Court will terminate the suit. Likewise, if Petitioner wishes to collect EAJA fees, Petitioner shall inform the Court of their intent within the next seven (7) calendar days and submit an EAJA application within thirty (30) calendar days of the grant of Petitioner’s Habeas Petition.
