MINUTE ORDER issued by Courtroom Deputy for District Judge Edward J Davila on 6/4/2026: It has come to this Court's attention that Petitioner Juan Robinson Cutz Torres already has an immigration habeas case filed in this district, Cutz Torres v. Warden, et al., 1:26-cv-03633-EJD ("Cutz Torres I"), which was filed on May 11, 2026. In Cutz Torres I, Petitioner is represented by Counsel, whereas in this action, Cutz Torres v. Warden, California City Immigration Processing Center, et al., 1:26-cv-04276-EJD ("Cutz Torres II"), Petitioner is proceeding pro se. Neither Respondents nor Petitioner's Counsel have filed a Notice of Related Cases in either Cutz Torres I or Cutz Torres II, and neither party has addressed why Cutz Torres II should not be dismissed as duplicative of his earlier-filed case, Cutz Torres I, which remains pending. Pursuant to Local Rule 123, "[c]ounsel who has reason to believe that an action on file or about to be filed may be related to another action on file... shall promptly file in each action and serve on all parties in each action a Notice of Related Cases." Accordingly, the parties are DIRECTED to file Notices of Related Cases in both Cutz Torres I and Cutz Torres II.
