Docket Text ORDER: This matter is before the Court on case review. In his response to the Show Cause Order, Respondent Gary Stolzer claims that Petitioner Brijesh Kumar Patel "was never admitted through any legal immigration process." Doc. 6 at 2. But the only evidence cited to support that proposition is the Petition itself, which states that Patel "entered the United States through O'Hare International Airport in approximately October 2003 after inspection by immigration authorities." Doc. 1 at 1. The Court instructed Stolzer to "address the relevance of the allegation that Petitioner was admitted with inspection in 2003," Doc. 3 at 2, but he has failed to do so. Accordingly, no later than July 10, 2026, Stolzer must file a supplemental brief of no more than 5 pages either: (a) detailing the evidence that Patel entered the United States without inspection or (b) admitting the allegation in the Petition that he entered after inspection and explaining why Avila v. Bondi, 170 F.4th 1128, 1132-33 (8th Cir. 2026) applies in this factual scenario. Either way, Patel must file a response to Stolzer's brief or a notice of intent not to do so no later than July 17, 2026. Signed by District Judge Zachary M. Bluestone on 7/6/2026.
