MINUTE ORDER: Petitioners' traverse (Dkt. 13 ) raises for the first time the argument that the alternative flight risk findings that occurred after the filing of their habeas petition were the result of the IJ's abuse of discretion or a denial of due process. Because this claim did not arise until after the petition had been filed, and because Respondents rely on the flight risk determinations in opposing habeas relief, the Court will exercise its discretion to consider these arguments even though they were not raised in the initial petition. However, Respondents should have an opportunity to be heard on those arguments. The Court therefore ORDERS that Respondents shall have until July 22, 2026 to file a supplemental brief addressing Petitioners' challenge to the flight risk determinations. The Clerk is directed to re-note the response to the habeas petition (Dkt. 9 ) and the traverse (Dkt. 13 ) for July 22, 2026. Entered at the direction of District Judge Tiffany M. Cartwright.
