MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 6/11/2026.Before the Court is Petitioner's 6 Amended Petition for Writ of Habeas Corpus which was filed pursuant to this Court's 4 Screening Order. Based on the Amended Petition, the Court finds Petitioner can likely establish his entitlement to immediate release from unlawful confinement pursuant to (i) Jacobo Ramirez v. Mullin, No. 2:25-cv-02136-RFB-MDC, 2026 WL 879799 (D. Nev. Mar. 30, 2026), and (ii) the Due Process Clause of the Fifth Amendment. Therefore, Respondents are HEREBY ORDERED to SHOW CAUSE why the 6 Amended Petition should not be granted. See 28 U.S.C. § 2243. Specifically, Respondents must file a notice of appearance and a "return certifying the true cause of [Petitioner Singh's detention] by June 15, 2026. See 28 U.S.C. § 2243.Respondents must further indicate whether they dispute Petitioner's status as a Jacobo-Ramirez Class Member in their Return. Unless Respondents contend Petitioner is not a Class Member, Respondents should not reargue their statutory interpretation under 8 U.S.C. § 1225(b)(2)(A). That statutory issue has been fully litigated by Respondents and resolved by the Court's Partial Summary Judgment in Jacobo-Ramirez, which has not been stayed or vacated. If Respondents contend there are other legal bases for Petitioner's ongoing detention, or other reasons why the relief requested in the Amended Petition should not be granted, Respondents must so indicate in their Return. IT IS FURTHER ORDERED Federal Respondents must PRODUCE the following records, which are relevant to the lawfulness of Petitioner's detention, with their Return: (1) I-200 Warrant for Arrest of Alien; (2) Form I-286 Initial Custody Determination; (3) Form I-862 Notice to Appear; (4) Form I-213 Record of Deportable or Inadmissible Alien; (4) any other records Federal Respondents rely on to justify Petitioners detention. See Rule 7, Rules Governing Section 2254 Cases in the United States District Courts ("If the petition is not dismissed, the judge may direct the parties to expand the record by submitting additional materials relating to the petition."); id. at Rule 1(b) (enabling a court to apply these rules to petitions brought under 8 U.S.C. § 2241). Alternatively, Respondents must CERTIFY that, after a diligent search, they have determined that such record(s) are not in their possession, custody, or control. IT IS FURTHER ORDERED Petitioner shall file a traverse by June 18, 2026. IT IS FURTHER ORDERED that this Court's prior Orders regarding briefing, filing, and removal remain in full effect.
