DESIGNATION

EO: The court has received and reviewed Petitioner's petition for writ of habeas corpus. Dkt. No. 1. The issues raised in the petition's only claim for relief appear to mirror those previously addressed by this court and others in a variety of cases, particularly whether Petitioner's due process rights have been violated. See, e.g., Estuardo G.C. v. Warden California City Det. Facility, No. 1:26-cv-02798-MWJS, 2026 WL 1166841 (E.D. Cal. Apr. 29, 2026) (unaccompanied minor granted parole); Brandon A.R. v. Warden of Golden State Annex, No. 1:26-CV-03004-MWJS, 2026 WL 1139597 (E.D. Cal. Apr. 27, 2026) (unaccompanied minor released pursuant to Trafficking Victims Protection Reauthorization Act); Elisbel S.V. v. Chestnut, No. 1:26-cv-03100-MWJS, 2026 WL 1246405 (E.D. Cal. May 5, 2026) (noncitizen granted humanitarian parole); Yoenis P.P. v. Warden of the Mesa Verde Detention Facility, No. 1:26-cv-03596-MWJS, 2026 WL 1481581 (E.D. Cal. May 27, 2026) (noncitizen released on his own recognizance or granted parole). Given the substantial percolation of these issues, the court intends to rule directly on the petition. See 28 U.S.C. §2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require."). On or before June 4, 2026, Respondent is ORDERED TO SHOW CAUSE as to whether there are any factual or legal issues in this case that render it distinguishable from each of the cases listed above and justify denying the petition, or indicate this matter is not substantively distinguishable. Petitioner may file a reply on or before June 8, 2026. This matter is not set for a hearing though the court may set one should it later be determined that a hearing is necessary. Pending the court's decision on the petition, and unless and until the court orders otherwise, the court ORDERS that Respondent shall not transfer Petitioner out of this district. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). IT IS SO ORDERED. (JUDGE MICAH W. J. SMITH) (ab) (Entered: 06/02/2026)
