ORDER: Petitioner Rene Ernesto Martinez Alvarenga filed a petition for a writ of habeas corpus under 28 U.S.C. § 2241 and a motion for a temporary restraining order. (Docs. 1, 2 ). For the reasons within, the court GRANTS Alvarenga's motion for a TRO as to his request to prevent Respondents from transferring him out of this judicial district. (Doc. 2 ). The court reserves ruling on the remaining requests in the motion for a TRO. This order is effective until June 16, 2026, unless the court extends it. ORDER TO SHOW CAUSE: Petitioner Alvarenga filed an emergency motion for the court to issue an order to show cause and require production of evidence. (Doc. 3 ). The court GRANTS IN PART Petitioner Alvarenga's motion. The court ORDERS Respondents Jordan Powell, Brian Acuna, David Venturella, Markwayne Mullin, and the U.S. Attorney General to appear and show cause, on or before June 5, 2026, at 12:00 PM CST, why the court should not grant Alvarenga's petition. Respondents must include a thorough discussion of all matters of fact and law relating to the petition. With their response, the court also ORDERS the respondents to produce the petitioner's complete immigration A-file, any administrative warrants or custody classification records, and other reasonably identifiable records bearing on the statutory and factual basis for the petitioner's detention. The court further GRANTS Petitioner's request for leave to file a traverse. See 28 U.S.C. § 2243; § 2248. Petitioner's traverse shall be filed on or before June 10, 2026. The court DIRECTS the Clerk to serve on Respondents and the United States Attorney for the Northern District of Alabama (1) a copy of this order, and (2) a copy of the petition for a writ of habeas corpus, (doc. 1 ).
