TEXT ORDER that, in response to Respondents' identification of Petitioner's counsel among their witnesses for the hearing, the Court hereby clarifies that it will not be considering counsel's opinion provided in her declaration as part of its determinations with respect to the conditions at Delaney Hall. (See Minogue Declaration paras. 11, 13, ECF No. 1-1). Her testimony is therefore not relevant. Moreover, counsel's declaration makes clear that her proffered opinions are based on reports rather than personal knowledge. See Fed. R. Evid. 602 and 701. Accordingly, the Court will not require her testimony at the hearing on Monday.
