ORDER TO SHOW CAUSE: Petitioner shall serve the Respondents with the Petition, exhibits, and this Order to Show Cause by July 1, 2026 by email and overnight mail pursuant to the service requirements outlined in Fed. R. Civ. P. 4(i). Within 48 hours of serving Respondents, Petitioner shall file proof of service on the docket, and counsel for Respondents shall promptly enter notices of appearance. On or before July 6, 2026, Respondents shall show cause why the Petition should not be granted. By the same deadline of July 6, 2026, the Parties shall complete and file the Magistrate Judge Consent Form [ECF 3 ]. On or before July 13, 2026, Petitioner may file a Reply in support of the Petition. In their briefing, the Parties should address Petitioner's CAT deferral and whether such status remains active. Respondents should also identify the reasons for revoking Petitioner's release, what procedures were followed, and what measures, if any, have been taken to effect Petitioner's removal. MINUTE ORDER. This Court finds, consistent with Quiroz, the Petitioner is detained pursuant to 8 U.S.C § 1226(a) and is entitled to a bond redetermination hearing. The Petition [ECF 1 ] therefore is granted. The Court orders that: 1) Respondents shall conduct such hearing within four business days, by July 13, 2026, and 2) the burden of proof shall be on the government to demonstrate by clear and convincing evidence that continued detention is justified. If Petitioner is not provided a bond determination hearing within this time, the Respondents shall release Petitioner. The Parties shall file a status report within five business days of this Order, by July 14, 2026, apprising the Court on whether the bond hearing was held, the result of such hearing, and/or whether Petitioner was released because of such hearing or in compliance with this Order.
