DOCKET TEXT ORDER. Plaintiffs shall promptly serve Defendants, in a manner that complies with Federal Rule of Civil Procedure 4, with summons and copies of 1 Complaint, 2 Emergency Motion for Temporary Restraining Order and for Immediate Injunctive Relief, and this docket text order. Once Plaintiffs have served these documents on Defendants, they shall promptly file proof of service.No later than four days after receipt of the service required by this order, Defendants shall respond to the following jurisdictional questions: (1) whether Plaintiff Alejandro Reza Viques was physically located in the District of Utah at the time the Complaint was filed; and (2) if he was not, whether the court otherwise has jurisdiction over his petition for a writ of habeas corpus under 28 U.S.C. § 2241 or any other claims for injunctive relief he asserts that arise out of his custody. If this deadline falls on a weekend or a federal holiday, the response may be filed by the end of the next business day. Plaintiffs may file a reply promptly after Defendants file their response. DOCKET TEXT ORDER. Petitioner/Plaintiff seeks emergency relief under 28 U.S.C. § 2241. See Dkt. No. 2. But the Government represents that he was located in Arizona at the time his counsel filed the petition. Although Petitioner/Plaintiff casts aspersions on the lack of sworn statements supporting the Government's representation, he neither offers any contrary allegations or evidence nor seriously disputes the Government's representation. Because Section 2241 authorizes courts to grant relief "only within their respective jurisdictions," the court concludes that it likely lacks jurisdiction to entertain either Petitioner/Plaintiff's petition or his request for emergency relief. See also Santillanes v. United States Parole Comm'n, 754 F.2d 887, 888 (10th Cir. 1985).Although the Government moves to dismiss this action, the court concludes that the action should instead be transferred, in "the interest of justice," to the District where Petitioner/Plaintiff was detained, and "the action [thus] could have been brought[,] at the time it was filed." 28 U.S.C. § 1631. The case is accordingly TRANSFERRED to the United States District Court for the District of Arizona for all further proceedings. SO ORDERED. Signed by Judge Howard C.
