TEXT ORDER: On May 27, 2026, petitioner was detained by Immigration and Customs Enforcement ("ICE") agents in Syracuse, New York, without a bond hearing. Dkt. No. 1 . That same day, petitioner filed an application for a writ of habeas corpus (the "petition") seeking release from custody or, alternatively, a bond hearing. Id. On June 2, 2026, respondents afforded petitioner an individualized bond hearing before an immigration judge who granted petitioner's request for release on bond, subject to his participation in ICE's Alternatives to Detention program. Dkt. No. 6-3 at 1315. Petitioner posted bond and was released from custody on June 9, 2026. Id. at 17; Dkt. No. 6-2 10. On June 10, 2026, respondents moved to dismiss the petition as moot in light of petitioners release. Dkt. Nos. 6, 6-1. Petitioner concedes mootness. Dkt. No. 8. Upon review of the submissions, the petition has been mooted by petitioner's release on bond. See Martin-Trigona v. Shiff, 702 F.2d 380, 386 (2d Cir. 1983) ("The hallmark of a moot case or controversy is that the relief sought can no longer be given or is no longer needed."). Without a live controversy, the Court lacks subject matter jurisdiction and declines to reach the remaining issues raised in the petition. Accordingly, it is ORDERED that respondents' 6 motion to dismiss the petition is GRANTED. It is FURTHER ORDERED that the 1 petition DISMISSED as moot. SO ORDERED by U.S. District Judge Anthony J.
