ORDER: (1) The Clerk of Court is directed to send a copy of Zhalnin's Petition (Doc. # 1), all relevant attachments (Doc. # 1-2), and this Order by electronic mail to the United States Attorney's Office for the Eastern District of Kentucky. (2) Within seven (7) days of the date of this Order, Respondents shall consider the impact of the Lopez-Campos decision on the present matter and, if the present matter must be resolved in Petitioner's favor under Lopez-Campos, Respondents shall immediately release Petitioner or, in the alternative provide Petitioner with a bond hearing pursuant to 8 U.S.C. § 1226(a), at which the government bears the burden of proving that detention is necessary by clear and convincing evidence. (3) Within ten (10) days of the date of this Order, Respondents shall file a Status Report with this Court certifying compliance with this Order. The Status Report shall state (1) whether Lopez-Campos resolves the issues raised in the Petition (Doc. # 1); (2) if Lopez-Campos resolves the issues in Petitioner's favor, whether Petitioner was released or provided a bond hearing; and (3) if Petitioner received a bond hearing, the date it occurred, whether bond was granted or denied, and, if denied, the reasons for such denial. (4) If Lopez- Campos does not resolve the issues raised in the Petition (Doc. # 1) in Petitioner's favor, Respondents shall file their response to the Petition within fourteen (14) days after the date of entry of this Order. The response should be in the form of a memorandum addressing the factual allegations and legal claims contained in the Petition. Neither a formal motion to dismiss nor a motion for summary judgment is appropriate for these proceedings. Respondents also should attach any relevant documentary evidence to their response brief. (5) Zhalnin shall file a reply in further support of her Petition within twenty- eight (28) days of the date of this Order. Signed by Chief District Judge David L Bunning on 5/28/2026.
