ORDER by Magistrate Judge Susan Prose on May 28, 2026. Upon review of Petitioner's Application for Writ of Habeas Corpus (ECF No. 1, the "Petition"), which requests, inter alia, that the Court assume jurisdiction, order Petitioners immediate release, order Respondents to return Petitioner to the District of Colorado, enjoin further transfers and removal, and disclose Petitioner's current custodial location, it is ORDERED that Petitioner shall serve Respondents with a copy of the Petition and accompanying papers, along with a copy of this Order, by e-mail and overnight mail, on or before May 29, 2026. Petitioner shall promptly file proof of such service on the docket, and counsel for Respondents shall promptly enter their notices of appearance. Within seven days of service, Respondents shall RESPOND to the Petition and SHOW CAUSE why the Petition shall not be granted. In doing so, Respondents are asked to briefly address: 1.Whether the issues presented here are materially different from the issues this Court has resolved in its prior §1231 prolonged detention cases, including but not limited to Pan v. Blanche, No. 26-cv-00599-SBP, and other Zadvydas-based challenges in this District; 2.Whether noncontinuous periods of post-order detention should be aggregated when evaluating whether detention has exceeded the presumptively reasonable six-month period under Zadvydas v. Davis, 533 U.S. 678 (2001), in light of this District's decisions in Pena-Gil v. Lyons, No. 25-cv-03268-PAB-NRN, Aguilar v. Noem, No. 25-cv-03463-NYW, and Lorenzzi-Gonzales v. Lyons, No. 26-cv-00821-CYC; 3.Whether Respondents complied with the notice and informal interview requirements of 8 C.F.R. §§ 241.4(l) and 241.13(i) prior to revoking Petitioner's Order of Supervision; and 4.Whether Petitioner has failed to administratively exhaust any claims asserted in the Petition. It is further ORDERED that the parties shall file a completed Magistrate Judge consent form (ECF No. 3) no less than seven days from the date of this Order. Respondents are hereby ENJOINED from transferring Petitioner outside the jurisdiction of the District of Colorado or removing Petitioner from the United States pending resolution of the Petition.
