ORDER holding in abeyance 1 Writ of Habeas Corpus and 2 Motion Requesting Order. Federal courts "may issue all writs necessary or appropriate in aid of their respective jurisdictions and agreeable to the usages and principles of law." 28 U.S.C. § 1651. Accordingly, this Court ORDERS that the United States, its agencies, and employees shall not transfer Petitioner outside the jurisdiction of this District Court until Respondents have been served with process and have filed an answer or other responsive pleading to Petitioner's Writ of Habeas Corpus. In accordance with 8 U.S.C. § 1226(a), noncitizens who are arrested and detained while residing in the United States are entitled to a bond hearing before a neutral decisionmaker, the opportunity to obtain representation by counsel, to present evidence, to appeal an adverse determination, and to seek a new hearing when circumstances materially change. See Rodriguez-Diaz v. Garland, 53 F.4th 1189, 1202 (9th Cir. 2022); Doe v. Tompkins, 11 F.4th 1, 2 (1st Cir. 2021); Brito v. Garland, 22 F.4th 240, 246 (1st Cir. 2021). Accordingly, this Court further ORDERS that Petitioner be granted a bond hearing before an Immigration Judge under the Department of Justice's Executive Office for Immigration Review, on or before June 4, 2026. The United States shall inform, on or before June 5, 2026, whether such bond hearing has been held, the outcome of the hearing, and file an answer, or responsive pleading, to Petitioner's for Writ of Habeas Corpus. ORDER. The Court has considered 10 Petitioner's Emergency Motion to Enforce the Court's Order (Dkt. 6), to Compel Petitioner's Return to the District of Puerto Rico, and for an Order to Show Cause. On May 26, 2026, Petitioner filed a Petition for Writ of Habeas Corpus along with a Motion Requesting Order (Docket Nos. 1; 2). On May 27, 2026, the Court directed "that the United States, its agencies, and employees shall not transfer Petitioner outside the jurisdiction of this District Court until Respondents have been served with process and have filed an answer or other responsive pleading to Petitioner's Writ of Habeas Corpus," with a deadline set for June 5, 2026, for Respondents' responsive pleading (Docket No. 6). Petitioner confirmed on the same day that service was executed upon Defendants (Docket No. 7). Despite the Court's order, Mr. Castillo-Suarez has been transferred outside of Puerto Rico to the Krome North Service Processing Center in Florida. As a result, Petitioner has sought an order for Mr. Castillo-Suarez's return to the District of Puerto Rico. The Court retains jurisdiction over the habeas petition, notwithstanding Mr. Castillo-Suarez's transfer, as supported by caselaw: Ozturk v. Hyde, 136 F.4th 382, 387 (2d Cir. 2025) (upheld the return of a Petitioner to the initial detention venue upon proper filing of a habeas petition); see also Ozturk v. Trump, 777 F. Supp. 3d 26, 36 (D. Mass. 2025) ("'[W]hen the Government moves a habeas petitioner after properly filing a petition naming his immediate custodian, the District Court retains jurisdiction.'") (quoting Rumsfeld v. Padilla, 542 U.S. 426, 441 (2004)). It is undisputed that Mr. Castillo-Suarez was under custody in Puerto Rico when his habeas petition was accurately filed. Given these circumstances, the Court GRANTS the Petitioner's motion at Docket No. 10 .The Court ORDERS that Mr. Castillo-Suarez must be returned to the District of Puerto Rico by June 2, 2026. Failure to comply with this Order will result in Garrett J. Ripa, as Mr. Castillo-Suarez's designated custodian, being held in contempt of court. Signed by Judge Gina R. Mendez-Miro on 5/29/2026. ORDER. The Court previously entered an Order at Docket No. 6, directing, among other things, that Petitioner not be transferred outside the jurisdiction until Respondents have been served with process and have filed an answer or other responsive pleading to Petitioner's Writ of Habeas Corpus. Petitioner then informed the Court that he had been transferred outside the District of Puerto Rico. The Court subsequently directed that Petitioner be returned to this District. Respondents have filed a Motion at Docket No. 11 stating that Petitioner's transfer occurred on May 26, 2026 --before service of the Petition and before the Courts May 27, 2026 Order-- and that Respondents therefore did not transfer Petitioner in violation of the Courts May 27, 2026 Order. Respondents also represent they have arranged the bond hearing ordered by the Court. Based on the record now before the Court, the Court finds that its prior directive ordering Petitioner's return to this District was entered without the benefit of Respondents' submitted timeline showing the May 26, 2026 transfer. To the extent the Court's prior Order was premised on a finding or implication that Respondents transferred Petitioner in violation of the Courts May 27, 2026 Order, that portion of the Order is VACATED. The Court further finds, however, that Petitioner's transfer does not divest the Court of jurisdiction over the pending Petition for Writ of Habeas Corpus. The Petition was filed in this District, and the Court retains authority to adjudicate the claims presented therein notwithstanding Petitioners subsequent transfer. Accordingly, IT IS ORDERED that: (1) The Court will continue to exercise jurisdiction over this matter and all previously established deadlines remain in effect; (2) Respondents shall, by no later than June 5, 2026: (a) Inform the Court whether the bond hearing ordered by the Court has been held; (b) If the hearing has been held, disclose the outcome of the hearing; and (c) File an answer or other responsive pleading to Petitioner's Writ of Habeas Corpus; and (3) The Court reiterates that the interests of justice require that the bond hearing be held expeditiously.
