TEXT ORDER This matter comes before the Court upon Petitioner Jean Claude Kibang's Petition for Writ of Habeas Corpus under 28 U.S.C. 2241. Dkt. No. 1, ("Petition"). Petitioner alleges his prolonged immigration detention after a bond hearing which lacked due process is unlawful. In accordance with Rule 4 of the Rules Governing 2254 Cases ("Habeas Rule 4"), applicable to § 2241 cases through Rule 1(b), scope of the Rules, this Court has screened the Petition for dismissal and determined dismissal without a full answer is not warranted. Respondents shall file an expedited answer to the Petition within 7 days. Petitioner may file a reply brief within 3 days of the filing date of the answer. TEXT ORDER This matter comes before the Court upon Petitioner Jean Claude Kibang's Petition for Writ of Habeas Corpus (Dkt. No. 1) challenging his March 10, 2026 bond hearing as fundamentally unfair and his continued immigration detention pursuant to 8 U.S.C. § 1226(a) as unreasonably prolonged. On June 3, 2026, Respondents submitted an answer (Dkt. No. 4) opposing the Petition. On June 5, 2026, Petitioner filed a reply (Dkt. No. 5). As Respondents argue, and the Court agrees, Petitioner has failed to provide a transcript of the March 10, 2026 bond hearing. Therefore, the Court orders Petitioner to submit a transcript of the March 10, 2026 bond hearing within seven (7) days. See e.g., Cahuec-Canahui v. Bondi, 26-364 (MEF), Dkt. No. 12 (Text Order) (holding that petitioner could not carry his burden to challenge his bond hearing because he failed to provide a transcript of the hearing). TEXT ORDER This matter comes before the Court upon Petitioner Jean Claude Kibang's Petition for Writ of Habeas Corpus (Dkt. No. 1) challenging his March 10, 2026 bond hearing as fundamentally unfair and his continued immigration detention pursuant to 8 U.S.C. § 1226(a) as unreasonably prolonged. On July 22, 2026, the Court ordered Petitioner to provide a transcript of the March 10, 2026 bond hearing. (Dkt No. 6.) On July 23, 2026, Petitioner submitted a letter requesting an extension of time to provide the bond hearing transcript along with a motion for leave to file an amended petition. (Dkt. No. 7.) On July 29, 2026, Petitioner submitted the transcript of the March 10, 2026 bond hearing. (Dkt. No. 8.) Accordingly, Petitioner's request for an extension of time (Dkt. No. 7.) is MOOT. Moreover, Petitioner requests leave to file an Amended Petition arguing that the procedural posture of his continued detention has shifted from 8 U.S.C. § 1226(a) to 8 U.S.C. § 1231(a) due to the Board of Immigration Appeals' dismissal of his appeal, which rendered his removal order final. (Dkt. No. 7 at 1-2.) For good cause shown, Petitioner's Motion for Leave to File an Amended Petition for Writ of Habeas Corpus (Dkt. Nos. 7-8) is GRANTED. Pursuant to Fed. R. Civ. P. 15(a)(2), the Clerk shall file the proposed Amended Petition for Writ of Habeas Corpus (Dkt. No. 7) as the operative pleading in this matter. Respondents shall respond to the Amended Petition within twenty-one (21) days of the date of this Text Order. Petitioner shall reply within three (3) days.
