MINUTE ORDER (Text Only Entry) This case, filed May 26, 2026, has been initiated by the same Petitioner who initiated a prior action, 1:26-cv-02421-JLT-FJS, in which the Court granted Petitioner's petition for habeas corpus and ordered Respondents to provide Petitioner with a bond hearing. In the present case, Petitioner indicates that his continued detention violates his rights under the INA and the Due Process Clause of the Fifth Amendment. (Doc. 1 at 5.) Pursuant to Local Rule 123, the Court finds that this action (1:26-cv-03986-MWJS) is related to Case No. 1:26-cv-02421-JLT-FJS because both cases involve overlapping parties, properties, claims, events and/or questions of fact or law. Accordingly, assignment of the actions to the same district judge and magistrate judge to promote convenience, efficiency, and economy for the Court and parties. Thus, the Court ORDERS that Case 1:26-cv-03695-MWJS is reassigned to U.S District Judge Jennifer L. Thurston and to Magistrate Judge Frank J. Singer. MINUTE ORDER (Text Only Entry) Petitioner Kener Jose Rodriguez Diaz (A No. 246-549-267) initiated two separate, substantially identical actions in this Court that were opened as Case No. 1:26-cv-00610-JLT-CDB and 1:26-cv-02421-JLT-FJS. In Case No. 1:26-cv-00610-JLT-CDB, this Court ordered Respondents on April 2, 2026, to provide Petitioner with a bond hearing before an immigration judge. In Case No. 1:26-cv-02421-JLT-FJS, this Court again ordered Respondents on April 29, 2026, to provide Petitioner with a bond hearing before an immigration judge. In the instant petition, Petitioner raises substantially similar issues that were decided in the prior habeas orders. Thus, this matter is DISMISSED as duplicative and/or moot.
