ORDER and FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Chi Soo Kim on 7/7/2026 DENYING without prejudice 2 Motion to Appoint Counsel and RECOMMENDING that 1 Petition for Writ of Habeas Corpus be granted as to claims one and four (due process and regulatory violation), and denied as to claims two and three (third country removal); that Petitioner be immediately released from ICE custody under the same conditions he was previously released in his 4/17/2014 Order of Supervision; that if respondents have custody of petitioner's documents, respondents shall return those to petitioner at the time of release; that Respondents be enjoined and restrained from re-detaining petitioner absent compliance with constitutional protections, which include, at a minimum, compliance with the requirements of 8 C.F.R. § 241.13(i) for revocation of release, and any other applicable statutory and regulatory procedures; that because petitioner is proceeding pro se, respondents be further directed to file a status report within 7 days from the date of his release; and that the Clerk of the Court be directed to enter judgment in favor of petitioner and close this case. Nunley on 7/16/2026 ADOPTING the 11 Findings and Recommendations in full, GRANTING the 1 Petition for Writ of Habeas Corpus as to Claims One and Four (due process and regulatory violation), and D ENYING the Petition as to Claims Two and Three (third country removal). Respondents are ordered to IMMEDIATELY RELEASE petitioner Cecilio G.L. (A# 024-456-566) from custody under the same conditions he was previously released in his 4/17/2014 Order of Supervision. At the time of release, Respondents must return all of Petitioner's documents and possessions and provide Petitioner with a copy of this Order. Respondents shall file a status report within two (2) court days from the date of th is Order certifying compliance with this provision. Respondents are ENJOINED AND RESTRAINED from re-detaining Petitioner absent compliance with constitutional protections, which include, at a minimum, seven days' pre-deprivation notice and com pliance with the requirements of 8 C.F.R. § 241.13(i) for revocation of release, and any other applicable statutory and regulatory procedures.
