MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Sean C. Riordan on 5/28/2026 DEFERRING the ruling on 2 Motion for Appointment of Counsel, GRANTING 3 Motion for IFP, and DIRECTING Respondent to SHOW CAUSE within 7 days why the Writ should not be granted. Absent a further order of the court, the petition will be taken under submission after the filing of the reply. To ensure this Court's jurisdiction to resolve the pending § 2241 petition, Respondents shall not transfer Petitioner to another detention center outside of this judicial district, pending further order of the Court. The parties shall inform the court as expeditiously as possible in the event that petitioner obtains an immigration bond and it is paid resulting in his release or that a travel document is obtained for petitioner that will result in his imminent removal from this country. Either party shall update the court by filing a Notice of Changed Circumstances that informs the court of the circumstances that have changed. FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Sean C. Riordan on 06/04/2026 RECOMMENDING that Petitioner Isaac Sanchez Martinez's, A# 240-139-977, 1 Petition for Writ of Habeas Corpus be granted as follows: a. Respondents shall immediately release Petitioner from custody. At the time of release, Respondents must return all of Petitioner's documents and possessions; b. Respondents may place Petitioner on standard conditions of supervision upon release; and c. Respondents be enjoined and restrained from re-detaining Petitioner unless they provide him with a bond hearing pursuant to 8 U.S.C. § 1226(a) and 8 C.F.R. § 1236.1(c)(8). It is also RECOMMENDED that Petitioner's 2 Motion to Appoint Counsel be denied as moot, that any order adopting these findings and recommendations include language that it does not address the circumstances in which Respondents may detain Petitioner in the event Petitioner becomes subject to an executable final order of removal and Petitioner receives notice of that final order of removal, that within 3 days of an order adopting these findings and recommendations, Respondents be required to file a notice of compliance confirming Petitioner's release, that the Clerk be directed to serve a copy of any order adopting these findings and recommendations on the Golden State Annex, and that the Clerk be directed to enter judgment for Petitioner and close this case.
