By 5:00 p.m. on June 4, respondents are ordered to show cause why an individualized bond hearing is not required under da Cunha v. Freden, --- F.4th --- (2d Cir. 2026), and to address the proper burden of proof and persuasion. Should respondents acknowledge that the instant petition presents no meaningful distinction from da Cunha, they shall either afford petitioner a bond hearing or release him in either case, on or before June 8, absent further order of this Court. See Guartazaca Sumba v. Crowley, No. 25-CV-13034, 2025 WL 3126512, at *5 (N.D. Ill. Nov. 9, 2025). The parties shall file a joint status report on or before June 15 indicating whether petitioner has received a hearing and / or been released.
