ORDER denying 2 Motion for TRO. 1. The petitioners motion for a temporary restraining order (Doc. 2) is DENIED.2.The court exercises its discretion under Rule 1(b) of the Rules Governing Section 2254 Cases in the United States District Courts, 28 U.S.C. foll. § 2254, to apply those rules to this § 2241 petition.3.The clerk shall serve a copy of the petition (Doc. 1) and this order on the proper respondent, Angela Hoover, Warden of Clinton County Correctional Facility, and on the United States Attorney, and note the address of the United States Attorney on the front of the docket sheet of this case. All documents filed by the parties and by the court shall be served upon the United States Attorney. See R. 4, 28 U.S.C. foll. § 2254.4.Within twenty-one (21) days after entry of this order, the respondent shall file an answer, motion, or other response to the allegations of the petition. See R. 4, 28 U.S.C. foll. § 2254; R. 5, 28 U.S.C. foll. § 2254.5.The petitioner shall, if she so desires, file a reply to the respondents answer or other pleading within fourteen (14) days after its service. See R. 5(e), 28 U.S.C. foll. § 2254.6.A determination as to whether the petitioner shall be produced for a hearing will be held in abeyance pending the filing of the respondents answer or other pleading.7.This matter is remanded to the United States magistrate judge to whom it was originally assigned for further pretrial proceedings. REPORT AND RECOMMENDATIONS re 1 Petition for Writ of Habeas Corpus, filed by Ramilaben D. Patel - it is respectfully recommended that the Court: (1) GRANT Petitioner's Petition (Doc. 1), and enter judgment for the Petitioner and against the Respondent; (2) ORDER Respondent to immediately release Petitioner; (3) ORDER that, within 48 hours, Respondent shall file a declaration or affidavit pursuant to 28 U.S.C. § 1746 confirming that Patel has been released from custody; (4) ORDER Respondent not to re-arrest Petitioner for fourteen days to ensure that this habeas remedy is effective; (5) ENJOIN Respondent from re-arresting or re-detaining Patel under 8 U.S.C. § 1225, permanently; (6) ORDER that, if, in the future, Respondent does detain Petitioner pursuant to 8 U.S.C. § 1226(a), Respondent shall, within ten days, afford her notice and an opportunity to be heard at a bond hearing before an immigration judge, who shall provide an individualized assessment as to whether Patel poses a flight risk or a danger to the community; (7) DIRECT Petitioner that, if Respondent seeks to detain her under § 1226(a) and fails to schedule a timely bond hearing, or seeks to detain her under § 1225 in violation of this Court's order, she may move to reopen this matter to seek expeditious relief; and (8) DIRECT the Clerk of Court to close this case. Further, given the unique circumstances of this case and the liberty interests at issue, the undersigned ORDERS that, notwithstanding Local Rule 72.3, any objections must be filed no later than January 28, 2026.
