ORDER. On November 25, 2025, the Honorable Sunshine S. Sykes issued an order granting the plaintiff petitioners' motion for class certification in Lazaro Maldonado Bautista et al v. Ernesto Santacruz Jr., No. 25-cv-01873, 2025 WL 3288403 (C.D. Cal. Nov. 25, 2025). In this order, Judge Sykes certified a nationwide class and extended "the same declaratory relief" that Judge Sykes had previously "granted to Petitioners to the Bond Eligible Class as a whole." Id. at *9. The Court directs the parties to address whether Mr. Montoya is a member of this nationwide class and the impact, if any, of Judge Sykes's order on the instant case. The parties shall respond in writing by 11:59 pm on December 5, 2025.Additionally, the Court notes that Respondents' response to Petitioner's motion for a temporary restraining order and preliminary injunction, ECF No. 14 (November 24, 2025), addresses the merits of the underlying habeas petition. If Respondents wish to file any further briefing opposing the underlying habeas petition, Respondents may do so by 11:59 PM on December 5, 2025.
