Order on Petition for Writ of Habeas Corpus

TEXT ORDER. Before the Court is the Petitioner, Carl Joinville's, Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. (ECF No. 1.) The Petitioner seeks that this Court either immediately release him or provide him with a "prompt, constitutionally adequate bond hearing[.]" Id. at 8. As the Government acknowledges, the officers that arrested Petitioner here possessed a Form I-200 Warrant of Arrest. (ECF No. 6 at 2.) The ordering of a bond hearing is the appropriate remedy here because I-200 warrants are directed to "[a]ny immigration officer authorized pursuant to sections 236 and 287 of the Immigration and Nationality Act..." and that "Section 236 of the INA is codified in 8 U.S.C. § 1226," which provides the immigration judge with the authority to consider releasing a detainee pending removal proceedings. See Desgazons v. Nessinger, CA No. 25-cv-459-MRD, ECF No. 8 at 3 (D.R.I. Oct. 22, 2025). Consequently, Respondents are hereby ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within seven (7) days of the date this Order. The Respondents are ordered to provide the Petitioner and his attorney with adequate notice of the date and time of that hearing. Finally, the Court ORDERS the Respondents to file a status report within two (2) days of the Petitioner's bond hearing, stating whether he has been grantedbond and, if his request for bond was denied, the specific reasons for that denial.
