Judge Brian E. Murphy: ELECTRONIC ORDER entered GRANTING the petition. “Respondents submit that the legal issues presented in this Petition are similar to those addressed by another session of this Court in Siguenza v. Moniz,” and that “[s]hould the Court follow the reasoning in Siguenza, it would reach the same result here. Dkt. 9 at 1. In Siguenza, 2025 WL 2734704, *3 (D. Mass. Sept. 25, 2025), the court ordered the petitioner released because “there [wa]s no significant likelihood that he w[ould] be removed in the reasonably foreseeable future” because he could not be removed to his country of citizenship and the government had not identified a potential third country or obtained travel documents for the petitioner. Accordingly, the Court GRANTS the petition and ORDERS that Petitioner be immediately released. Any request for fees should be filed within the deadlines set by the Equal Access to Justice Act, 28 U.S.C. s. 2412. (MBM) (Entered: 05/29/2026)
