MINUTE ORDERORDER (Text Only Entry). The Court has reviewed the Petition for Writ of Habeas Corpus and the ex parte Application for Temporary Restraining Order. ECF Nos. 1, 2. Ruling on the Petition for Writ of Habeas Corpus and the Application and Motion for Temporary Restraining Order is reserved at this time. Respondents shall file any opposition to the Petition and the application for TRO by May 27, 2026. Any response must include Petitioner's (A-File # 216398930) full and complete Form I-213, any orders of release or detention, any custody warrants or notices, and any other portions of Petitioner's A-File relevant to the determination of the issues presented in the Petition, including available documentation related to any asserted violations of release conditions. Failure to timely respond shall be construed as a non-opposition. See L.R. 230(c). Respondent is directed to indicate on or before the filing deadline (1) whether they are requesting a hearing; and (2) whether they request additional briefing on the merits of the petition. Respondent is further directed to address the impact of Petitioner's prior related cases on this Petition. Depending on the content of the filings, the Court may set a hearing or may rule on the papers. In the meantime, pending a ruling on the Petition for Writ of Habeas Corpus, the Court orders that Respondents shall not transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction."). MINUTE ORDER issued on 6/10/2026 by the Courtroom Deputy for District Judge Dena M. Coggins: In Petitioner's 2 Motion for a Temporary Restraining Order, Petitioner contends that the bond hearing provided to him on 3/23/2026 pursuant to the court's order in Mendez Roblero v. Bondi, No. 1:26-cv-01550-DC-CSK, was insufficient because the Immigration Judge did not adequately consider all factors required under Matter of R-A-V-P, 27 I&N Dec. 803 (BIA 2020) in determining that Petitioner presented a flight risk. To the extent Petitioner argues that the evidence submitted by Respondents at Petitioner's bond hearing was insufficient to warrant his continued detention, Petitioner must appeal that determination to the Board of Immigration Appeals before pursuing habeas relief. Loba L.M. v. Andrews, No. 1:25-cv-00611-JLT-SAB, 2026 WL 710307, at *8 (E.D. Cal. Mar. 13, 2026) ("Petitioner challenges the sufficiency of the evidence supporting the immigration judge's bond determination rather than the constitutionality of the process by which that determination was reached... Complaints about the conclusion the IJ reached must be presented through the normal immigration appeal process."). Indeed, Petitioner acknowledges that he timely filed an appeal to the Board of Immigration Appeals, and that appeal remains pending. Thus, Petitioner did not exhaust his administrative remedies before filing his 1 Habeas Petition, and therefore Petitioner has not demonstrated a likelihood of success on the merits of his claim that his continued detention violates his constitutional or statutory rights and his 2 Motion for a Temporary Restraining Order is DENIED.
