ORDER denying 3 Motion for TRO Petitioner filed a Motion for Temporary Restraining Order. The Motion requests an order granting him immediate release. This is the same substantive relief sought by his Petition for Habeas Corpus. To that end, the Motion for Temporary Restraining Order does not seek to maintain the status quo, but rather, to obtain the substantive relief sought by his Petition. This is not an appropriate basis for a TRO. As such, it will be denied to the extent that the Motion seeks Petitioner's release or any other substantive relief sought by the Petitioner. The Court will adjudicate his petition pursuant to the case management order that will issue forthwith. The Motion also asks the Court to enjoin Petitioner's transfer from this district. The Court does not have the jurisdiction to enjoin an alien's transfer or otherwise determine where he will be detained. The place of an alien's detention is left to the discretion of the Attorney General and courts lack jurisdiction to enjoin a detainee's transfer. See Calla-Collado v. Attorney General of the US, 663 F.3d 680, 685 (3d Cir. 2011. For these reasons, the Motion for Temporary Restraining Order is denied.. Signed by Judge William S. Stickman on 5/21/2026.
