MEMORANDUM ORDER - This matter comes before the Court on Petitioner Olufemi Ayodele Oladejo's Motion for Temporary Restraining Order (the "Motion"), (ECF No. 2), and Petition for Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2241 (the "Petition"), (ECF No. 1 ). The Court DENIES the Motion because Petitioner's counsel does not qualify as a next friend. First, counsel has not shown that Petitioner is unavailable to litigate his own case simply because he is detained. Because Petitioner's counsel does not qualify as a "next friend," he is not the proper party of interest in this matter, and the Court lacks jurisdiction to consider the Motion and the instant Petition.
