TEXT ORDER granting Petitioner's request for a bond hearing before an Immigration Judge.On November 14, 2025, Petitioner, a noncitizen with Special Immigrant Juvenile Status ("SIJ status"), filed an "emergency petition" for a writ of habeas corpus, arguing that his detention is unlawful under 8 U.S.C. 1226(a) and seeking at least an individualized bond hearing, but principally and particularly due to his SIJ status, his immediate release and additional injunctive relief to curb the possibility of unlawful re-detention. ECF No. 1 at 1, 16-17. The Court ordered that Respondents show cause within 14 days as to why the petition should not be granted. ECF No. 2. Respondents filed a response on November 20, contending that pursuant to the Court's recent decisions, e.g., Da Cunha v. Freden, 25-cv-06532-MAV, ECF No. 25 (W.D.N.Y. Oct. 20, 2025), although they disagree with such, that further briefing or oral argument is not needed to grant Petitioner a bond hearing. ECF No. 4. Respondents did not address Petitioner's SIJ status or the alternative forms of relief he requested. See id. Petitioner filed a letter on December 10, 2025, requesting a status on the matter and stating, "Petitioner respectfully asks that the Court grant the Petition under the same reasoning as Da Cunha and order a bond hearing be held." ECF No. 5.In light of Petitioner's December 10 letter, for the reasons stated above and in a forthcoming written decision that will fully discuss the Court's rationale, Petitioner's emergency petition for a writ of habeas corpus is GRANTED to the extent that Respondents shall conduct a bond hearing within ten (10) days of the date of this Order. If such bond hearing is not conducted within ten (10) days of the date of this order, Petitioner shall be released from custody. Respondents shall file a status report no later than December 23, 2025, confirming that Petitioner has either been granted a bond hearing within ten (10) days or released from custody, in compliance with this Order.
