Stearns: ELECTRONIC ORDER entered.Petitioner Alejandro Josue Cervantes-Mencia concedes that he has a final order of removal and is being detained for removal under 8 U.S.C. § 1231(a)(6). In Zadvydas v. Davis, 533 U.S. 678 (2001), the Supreme Court defined the contours of the due process due to an individual with a final order of removal discretionarily being detained under § 1231(a)(6). Detention is permissible "until it has been determined that there is no significant likelihood of removal in the reasonably foreseeable future." Id. at 689.Petitioner fails to show that there is no significant likelihood of removal in the reasonably foreseeable future. Indeed, by his own account, ICE intends to deport him on the next available flight to Honduras. The petition accordingly is dismissed. (RGS, law3) (Entered: 06/01/2026)
