ELECTRONIC ORDER: The Court has reviewed the Petitioner's Motion for Temporary Restraining Order and Preliminary Injunction [Doc. 5]. The court declines to grant the Petitioner ex parte relief on the showing made. Accordingly, the Motion is denied. The Court notes that to the extent Petitioner seeks in his Motion to have this Court enjoin ICE from transferring him to another facility within the United States, such a transfer would not affect this Court's jurisdiction over the Petitioner's Habeas Petition. See Griffin v. Ebbert, 751 F.3d 288, 290 (5th Cir. 2014). The court directs the clerk of court to serve the respondents forthwith and refers the Petition for Writ of Habeas Corpus [Doc. 1] to the Magistrate Judge to issue an expedited briefing schedule and, thereafter, a report and recommendation on the merits of Petitioner's claims.
