MINUTES OF IN CHAMBERS - ORDER CONSOLIDATING MOTION FOR PRELIMINARY INJUNCTION WITH THE HABEAS PETITION by Judge Dolly M. Gee: Petitioner, an immigration detainee who proceeds pro se (i.e., self-represented), filed a petition for writ of habeas corpus under 28 U.S.C section 2241, Doc No. 1, simultaneously with a "Notice of Motion and Ex Parte Motion for Temporary Restraining Order" ("TRO") 2 . The bases for relief in the Motion for TRO are the same as those asserted in his habeas petition--the lack of a pre-deprivation hearing before his detention in 2025 and Respondents' mandatory detention policy. The Motion for TRO seeks immediate release from custody and an injunction preventing re-detention absent a pre-deprivation hearing. The Court converts the Motion for TRO to a Motion for a Preliminary Injunction ("MPI"). Given that the petition and the MPI raise the same claims and generally seek the same relief, and for purposes of judicial efficiency, the Court intends to consolidate a ruling on the MPI with a ruling on the habeas petition. The Court has already issued an order setting an expedited briefing schedule on the habeas petition. The same briefing schedule shall apply to the MPI. Thus, the parties shall comply with the briefing schedule set forth in that Order, and no hearing will be held on the MPI unless the parties are notified by the Court. A copy of the form for Petitioner to consent to the jurisdiction of a United States Magistrate Judge shall also be sent to Petitioner with this Order. Court Reporter: Not Reported. MINUTES OF IN CHAMBERS - ORDER REFERRING CASE TO THE FEDERAL PUBLIC DEFENDER TO CONSIDER APPOINTMENT OF COUNSEL by Judge Dolly M. Gee: Petitioner, an immigration detainee who is proceeding pro se, filed a Petition for a Writ of Habeas Corpus under 28 U.S.C. section 2241. There is no absolute right to appointment of counsel in habeas proceedings. Here, the Weygandt factors sufficiently support the appointment of counsel to represent Petitioner. The office of the Federal Public Defender for the Central District of California ("FPD") has indicated that it will review requests for appointment of counsel to represent pro se petitioners in immigration-related habeas corpus proceedings such as this one. Accordingly, the Court REFERS this case to the FPD for consideration of appointment of counsel for Petitioner. The FPD is ORDERED to file a response within seven days of this order, indicating whether the FPD will represent Petitioner in this matter, decline representation in this matter, or recommend appointment of CJA counsel.
