TEXT ORDER: Before the Court is Petitioner's emergency motion to transfer to Rhode Island wherein, he asks this Court to Order the Respondents to transfer him from the Karnes County Immigration Processing Center in Texas back to the Wyatt Detention Center in Rhode Island. ECF No. 5 . The Respondents argue that the Court must deny the Petitioner's request because the Petitioner was transferred to Texas on May 18, 2026 and the instant petition for writ of habeas corpus was not filed until May 19. After considering the parties' submissions and the exhibits attached thereto, the Court DENIES the Petitioner's motion to transfer. While the Court may retain jurisdiction over the petition for writ of habeas corpus based on Petitioner's representation that, at the time of filing, the Petitioner's last known location was Wyatt, the Court will not exercise that authority by ordering DHS/ICE to return the Petitioner to Rhode Island. In this instance, the transfer to Texas occurred prior to the case being filed in this Court. See Rumsfeld v. Padilla, 542 U.S. 426, 450 n.18 (2004) (explaining that a petitioner's last known location is the proper location to file a petition for writ of habeas corpus.). Absent evidence that the Petitioner was transferred to Texas in violation of a Court order or in an attempt to evade habeas jurisdiction, the Court will not exercise its authority to interfere with DHS/ICE's decisions regarding detainee transfers.
