MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Allison Claire on 05/26/2026. Respondents have filed a notice of related cases 4 stating that petitioner currently has two actions proceeding in this court: (1) Juarez-Bautista v. Chestnut, 1:26-cv-3232 DJC AC, filed pro se, and (2) the instant case, filed through counsel. The court has reviewed the petitions and finds that petitioner appears to be the same individual and that both petitions raise similar challenges to his present detention. Petitioner has no right to maintain two separate actions in this case challenging his detention. See MHC Fin. Ltd. P'ship v. City of San Rafael, 714 F.3d 1118, 1133 (9th Cir. 2013) ("a litigant has no right to maintain two separate actions involving the same subject matter at the same time in the same court and against the same defendant"). Within 7 days, counsel for petitioner shall notify the court how petitioner intends to proceed with his two cases. In the event petitioner chooses to dismiss his pro se petition, counsel shall also advise whether he intends to facilitate the voluntary dismissal of that action. (Text Only Entry) (Deputy Clerk JAA) (Entered: 05/26/2026)
