ORDER DENYING AS PREMATURE 23 Motion for EAJA Fees as to Alex Andres Japon Benites. Petitioner has not requested the court to enter final judgment in this matter or dismissed his claim seeking a declaration "that Respondents' actions to arrest and detain Petitioner violate the Due Process Clause of the Fifth Amendment." (Doc. 9 at 8.) As a result, the court has not entered final judgment in this case. On December 23, 2025, Petitioner filed a motion for attorney's fees under the Equal Access to Justice Act ("EAJA"). To be eligible for attorney's fees, the EAJA requires, among other things, "that any fee application be submitted to the court within [thirty] days of final judgment in the action[.]" Comm'r, I.N.S. v. Jean, 496 U.S. 154, 158 (1990); see also 28 U.S.C. § 2412(d)(1)(B) ("A party seeking an award of fees and other expenses shall, within thirty days of final judgment in the action, submit to the court an application for fees and other expenses[.]"). Because a final judgment has not yet been entered in this case, Petitioner's motion for EAJA fees is DENIED without prejudice as premature. See, e.g., Joell v. Wormuth, 2025 WL 2775915, at *7 (N.D.N.Y. Sept. 30, 2025) ("[S]ince no final judgment has been entered, plaintiff's application for EAJA fees is premature.
