Nunley on 5/19/2026: The Court has reviewed Petitioner's Petition for Writ of Habeas Corpus and Motion for Temporary Restraining Order ("TRO"). (ECF Nos. 1, 2 . ) The Court intends to rule directly on the Petition for Writ of Habeas Corpus, with the understanding that the Court will also consider any arguments made in support of the motion for TRO. See Fed. R. Civ. P. 65(a)(2). Therefore, Respondents shall file responsive papers to the habeas petition by May 26, 2026. Any response must include Petitioner's full Form I-213 for each immigration encounter, any orders of release or detention, any custody warrants or notices, and any other portions of Petitioner's A-File relevant to the determination of the issues presented in the habeas petition. Failure to timely respond shall be construed as a non-opposition. See L.R. 230(c). Petitioner may file a reply, if any, by June 1, 2026. Pending the Court's ruling on the Petition, the Court ORDERS that Respondents shall not transfer Petitioner out of this District. See F.T.C. v. ORDER signed by Chief District Judge Troy L. Nunley on 7/23/2026 GRANTING 1 Petition for Writ of Habeas Corpus. Respondent must IMMEDIATELY RELEASE Petitioner Julian Felipe Ramirez Saavedra (A No. 220-512-501) from custody under the same conditions he was released prior to his current detention. At the time of release, Respondent must return all of Petitioner's documents and possessions. Respondent must file a notice certifying compliance with this provision of the Court's Order within 2 court days from the date of this Order. Respondent is ENJOINED AND RESTRAINED from re-arresting or re-detaining Petitioner absent compliance with constitutional protections, including a minimum of 7-days' notice and a pre-deprivation hearing before a neutral fact-finder where Respondent shows material changed circumstances demonstrate a significant likelihood of Petitioner's removal in the reasonably foreseeable future, or Respondent demonstrates by clear and convincing evidence that the government's interest in protecting the public and/or ensuring Petitioner appears at future immigration proceedings outweighs Petitioner's constitutionally protected interest in remaining free from detention. At any such hearing, Petitioner shall be allowed to have counsel present. 2 Motion for TRO is DENIED as MOOT. 7 Motion to Dismiss and 14 Motion to Dissolve the Not Transfer Order are DENIED.
