Judge Allison D. Burroughs: ELECTRONIC ORDER entered. Currently before the Court is Petitioner’s petition for writ of habeas corpus. [ECF No. 1 ]. Petitioner is a native of Jamaica who entered the country on a J2 visa in 2021, and his legal status expired in 2024. [ECF No. 7-4]. On March 6, 2026, Petitioner was arrested in Bridgeport, Connecticut for motor vehicle and weapon related violations. [ECF No. 7-1]. He was subsequently arrested by Immigration and Customs Enforcement (ICE) on May 18, 2026. [ECF No. 7 at 3]. Petitioner now requests immediate release or, alternatively, a bond hearing under 8 U.S.C. § 1226(a). [ECF No. 1 at 18]. He argues that his denial of a bond hearing is a violation of the Fifth Amendment and that he was arrested unlawfully without a warrant or Notice to Appear (NTA) in violation of 8 C.F.R. § 1236.1(b), which requires that “[a]t the time of issuance of the notice to appear, or at any time thereafter and up to the time removal proceedings are completed, the respondent may be arrested and taken into custody under the authority of Form I-200, Warrant of Arrest.” [Id. at 2].Respondents have filed copies of Petitioner’s Form I-200 arrest warrant issued May 16, 2026, and served on Petitioner May 18, 2026, as well as Petitioner’s Notice to Appear, which was issued May 18, 2026, the same day as his arrest, indicating that the requirements of 8 C.F.R. § 1236.1(b) were met. [ECF No. 7-2]; [ECF No. 7-4]. While Respondents concede that Petitioner is detained pursuant to 8 U.S.C. § 1226(a), and that he thus is eligible for a bond hearing, [ECF No. 7 at 1], they claim that Petitioner has failed to exhaust his administrative remedies by first requesting a bond hearing before an immigration judge, [id. at 7–9]. Petitioner is required to exhaust administrative remedies before seeking habeas relief. See, e.g., Quinonez Mercado ex rel. Abarca-Jovel v. Dep't of Homeland Sec., No. 25-CV-12066, 2025 WL 2430423, at *3 (D. Mass. Aug. 22, 2025) (denying habeas petition where there was no evidence that petitioner had requested bond hearing). Accordingly, Petitioner’s petition is DISMISSED without prejudice.(CAM) (Entered: 06/04/2026)
