District Judge Julia E. Kobick: ELECTRONIC ORDER entered. On May 22, 2026, the Court held a hearing on petitioner Nicolas Al Varenga Lima’s petition for a writ of habeas corpus under 28 U.S.C. § 2241 and ordered his release pending a final ruling on the petition. ECF 17 . At the hearing, the Court made tentative rulings that Al Varenga Lima’s detention was not permissible under 8 U.S.C. §§ 1231(a)(1)-(2) or (a)(6) and that his detention did not comport with due process. ECF 17 . The Court also gave the respondents leave to file a sur-reply brief to address the new arguments made in Al Varenga Lima’s reply brief, some of which the Court adopted in its tentative rulings, and to address the Court’s tentative rulings. Id. The respondents have now indicated that they do not wish to substantively address the Court’s tentative rulings or the reply brief, and that they will instead rely on their initial response to the habeas petition. ECF 18 . Accordingly, the Court hereby adopts its tentative rulings as stated on the record at the May 22, 2026 hearing. For the reasons outlined orally at that hearing, Al Varenga Lima’s petition, ECF 1, is GRANTED, and judgment shall enter in his favor. (Currie, Haley) (Entered: 06/08/2026)
