Judge Brian E. Murphy: ELECTRONIC ORDER entered GRANTING the petition. Respondents assert that Petitioner is a Guerrero Orellana class member and “submit that the legal issues presented in this Petition are similar to those recently addressed by this Court in Martinez v. Hyde, [], Romero v. Hyde, [], and De Souza Rodrigues v. Wesling, No. 25-cv-13752-BEM (D. Mass. Dec. 17, 2025).” Dkt. 6 at 1. Accordingly, Petitioner is “subject to detention under 8 U.S.C. [s.] 1226(a).” Guerrero Orellana, 2025 WL 3687757, at *10 (D. Mass. Dec. 19, 2025). The Court ordered Respondents to include, as part of their response to the petition “copies of any Notices to Appear, Warrants for Arrest of Alien, or Notices of Custody Determination issued in connection with Petitioner’s current detention.” Dkt. 4 at 2. The Court’s order stated plainly that if “8 U.S.C. s. 1226 governs Petitioner’s detention, and a warrant has not been provided, Petitioner will be ordered released.” Id. Respondents included a Notice to Appear, Dkt. 6 -2, but failed to include a warrant that would support Petitioner’s detention under section 1226(a). Accordingly, the Court GRANTS the petitioner and ORDERS that Petitioner be immediately released.(MBM) (Entered: 05/20/2026)
