Calabretta on 6/1/2026: On May 18, 2026, Petitioner filed a Petition for Writ of Habeas Corpus (ECF No. 1 ) and a Motion for Temporary Restraining Order (ECF No. 2 ). Based on the information in the Respondents' Opposition (ECF No. 9 ), the Court cannot presently find that Petitioner has a likelihood of success on the merits as Petitioner's present detention appears mandatory under 8 U.S.C. § 1226(c) and was taken directly into custody from CDCR. In his Petition, Petitioner noted the possibility of "an as-applied due process challenge" (ECF No. 1 ¶ 22), but the Petition does not address this argument further and Petitioner did not file a Reply to Respondents' Opposition. Accordingly, Petitioner's Motion for Temporary Restraining Order (ECF No. 2 ) is DENIED. This matter is REFERRED to the assigned Magistrate Judge for further proceedings.
