TEXT ORDER - Before the Court is Respondents' letter informing the Court that on May 29, 2026, it was determined that Petitioner failed to establish a reasonable fear of persecution or torture upon return to Guatemala, and on June 4, 2026, an Immigration Judge affirmed the negative fear finding. (See ECF No. 9 .) Respondents submit that counsel informed Respondents that Petitioner does not intend on appealing the negative fear finding to the Third Circuit Court of Appeals. (See id.) Petitioner's pending habeas petition challenges his ongoing detention pursuant to a reinstated final order of removal, arguing that his removal is not likely in the foreseeable future because he cannot be removed until the completion of his reasonable fear process. (See generally ECF No. 1 .) It appears that Petitioner's reasonable fear process is now complete. Accordingly, it is ORDERED that within three (3) days of the entry of this Text Order, Petitioner shall inform the Court if he wishes to voluntarily withdraw his pending habeas petition.So Ordered by Judge Julien Xavier Neals on 6/22/2026.
