ORDER TO SHOW CAUSE - 1. The petition is deemed filed; 2. Counsel for the petitioner is directed to serve a copy of the petition, any exhibits, and this order on the respondents and the United States Attorney for the Middle District of Pennsylvania; 3. Without expressing an option on jurisdiction or the merits of this claims, the court fids that a response is required and issues this order to show cause; 4. On or before June 2, 2026, respondents shall show cause why the petition should not be granted; 5. The response shall address the factual averments in Diarra's petition; 6. The responses shall include petitioner's full A-File file from DHS. In lieu of the full A-file, the government shall include all documents within its possession, custody, or control which concern the petitioner's immigration proceedings, and which reflect any asserted reason for his continued detention; 7. Petitioner, if desired, may file a reply (traverse) on or before June 9, 2026; and, 8. A determination as to whether the petitioner shall be produced for a hearing will be held in abeyance pending the filing of a response. Show Cause Response due by 6/2/2026. MEMORANDUM ORDER - GRANTING in part 1 Petition for Writ of Habeas Corpus filed by Souleymane Diarra; The government shall, within 14 days of the date of this order, provide Diarra with an individualized bond hearing before an IJ in accordance with the analysis in the memorandum order ; At that hearing, the government will bear the burden of establishing, by clear and convincing evidence, that Diarra's continued detention is necessary because he presents a flight risk or danger to the community if released; On or before July 24, 2026, respondents shall file a declaration or affidavit pursuant to 28 U.S.C. § 1746 confirming that Diarra has received a bond hearing in accordance with this memorandum or has been released;and the Clerk of Court is directed to CLOSE this case.
