ORDER TO SHOW CAUSE: By 5:00 p.m. on May 21, 2026, Respondents shall show cause in writing why a writ of habeas corpus should not be issued, see ECF No. 1 ("Emergency Petition for Writ of Habeas Corpus"), and shall file (under seal if necessary) any documents from Petitioner's immigration file relevant to the issues raised in the Petition. Respondents' response to this Order to Show Cause must indicate Respondents' position on whether there is any particularized reason to believe that Petitioner presents a danger to the community or a flight risk and, to the extent that Respondents contend that Petitioner was detained in January 2026 pursuant to 8 U.S.C. § 1225(b)(2)(A), must show cause why the Petition should not be granted in light of the decision of the United States Court of Appeals for the Second Circuit in Barbosa da Cunha v. Freden, No. 25-3141-pr, 2026 WL 1146044 (2d Cir. Apr. 28, 2026) and the reasoning set forth in the May 12, 2026 Memorandum and Order issued by United States District Judge Sanket J. Bulsara in Inestroza Carbajal v. Frazier, No. 26-CV-02778, 2026 WL 1309265 (E.D.N.Y. May 12, 2026). Any reply by Petitioner shall be filed by 5:00 p.m. on May 26, 2026.
