ORDER signed by District Judge Dena M. Coggins on 08/21/2026 ADOPTING the 14 Findings and Recommendations and GRANTING Petitioner Mariano Dionel Moreno Rodriguez's (A# 234-995-315) 1 Petition for Writ of Habeas Corpus. Respondents shall IMMEDIATELY RELEASE Petitioner. At the time of release, Respondents must return all of Petitioner's documents and possessions. Respondents shall not impose any additional restriction on Petitioner unless it is determined to be necessary at a future pre-deprivation/custody hearing. If the government seeks to re-detain Petitioner, they shall provide him with a bond hearing pursuant to 8 C.F.R. 1236.1(c)(8) at which Petitioner shall bear the burden of showing that he is not a flight risk or a risk to community safety. The order does not address the circumstances in which Respondents may detain Petitioner in the event Petitioner becomes subject to an executable final order of removal and Petitioner receives notice of that final order of removal. Within 3 days from the entry date of this order, Respondents shall file a notice of compliance with this court confirming Petitioner's release from custody. Petitioner's pending 11 Motion is DENIED as having been rendered moot by this order and Respondents' pending 6 Motion is DENIED. CASE CLOSED.
