ORDER. Before the Court is 2 Petitioner's Application for Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2241. ORDER. Petitioner filed the Emergency Motion for Stay Pending Appeal 14, citing Fed. R. App. P. 8(a)(1)(A) and Nken v. Holder, 556 U.S. 418 (2009) for the proposition that this Court can stay its judgment while he appeals ICE's decision to deny his application for administrative stay of removal. ECF No. 14 paras. 31-35. Petitioner filed the instant Motion on July 9, 2026, after the Court entered final judgment on July 1, 2026. Fed. R. App. P. 8(a)(1)(A) states "[a] party must ordinarily move first in the district court fora stay of the judgment or order of a district court pending appeal." Rule 8(a)(2)(A) further explains that "[a] motion for the relief mentioned in Rule 8(a)(1) may be made to the court of appeals or to one of its judges" Additionally, Nken v. Holder examines the judicial review to grant a stay of pending appeal within the federal court system, not the immigration court system. From the Court's review, Rule 8 and Nken do not provide this Court authority to issue the requested stay, pending Petitioner's appeal of ICE's decision to deny his application for administrative stay of removal, following entry of final judgment in this case.
