MINUTE ORDER (Text Entry Only) This is Petitioner's second habeas petition. He previously filed in Case No. 1:26-cv-1338. Petitioner (A File #: 087-004-625) asserted that he has been detained since January 7, 2026 (Case # 1:23-1338, Doc. 1 at 3), more than 4 months ago. In that earlier case, the Court determined that he was taken into custody properly because he had been convicted of crimes involving moral turpitude. (Case No. 1:26-cv-1338, Doc. 12) In this new action, he alleges that more than two months ago, he successfully had these convictions vacated because he did understand the immigration consequences of his guilty pleas. (Case No. 1:26-3718, Doc. 1 at 4) He does not explain his delay in seeking his request for a temporary restraining order or why despite this delay, the Court should treat the situation as an emergency. Thus, the TRO request is untimely, and it is DENIED. Local Rule 231(b). The Court refers the matter to the assigned magistrate judge for a determination on the merits. The Court sets the following briefing schedule, which may be modified by the magistrate judge as needed. Respondents SHALL file their responsive pleading within 21 days.
