MEMORANDUM ORDER (Granting 28 U.S.C. § 2241 Petition) - For the above reasons, the Court GRANTS the Petition (ECF No. 1 ) and hereby ORDERS that: Respondents shall provide Petitioner with a bond hearing in front of an Immigration Judge pursuant to 8 U.S.C. § 1226(a). The Immigration Court shall provide Petitioner with the opportunity for a bond hearing before any hearing on the merits of his removal, and no later than seven (7) days from the date of entry of this Order. Respondents are ENJOINED from denying bond to Petitioner on the basis that he IS detained pursuant to 8 U.S.C. § 1225(b)(2). Respondents are ORDERED to file a status report with this Court within three (3) days of Petitioner's bond hearing and before any hearing on the merits, stating whether Petitioner has been granted bond, and, if his request for bond was denied, the reason for that denial. ORDER (Denying as Moot Motion for Temporary Restraining Order) - This matter comes before the Court on Petitioner Zelaya Herrera Enier Danilo's ("Petitioner") "Motion for Temporary Restraining Order / Preliminary Injunction" (ECF No. 3 ("Motion")), in which Petitioner seeks release from what he purports to be his unlawful detention. The Court recently granted Petitioner's Petition for a Writ of Habeas Corpus (ECF No. 1 ), ordering that Respondents provide Petitioner with a bond hearing before an Immigration Judge pursuant to 8 U.S.C. § 1226. ORDER (Ordering Status Report) - This matter comes before the Court on its own initiative. On May 21, 2026, the Court entered an Order granting Petitioner Zelaya Herrera Enier Danilo's ("Petitioner") Petition for a Writ of Habeas Corpus under 28 U.S.C. § 2241 (ECF No. 1 ("Petition" or Pet.)) and ordering Respondents to provide Petitioner with a bond hearing in front of an Immigration Judge within seven (7) days of the Court's Order's issuance. (ECF No. 9 .) Respondents filed a notice with the Court on May 29, 2026, confirming that a bond hearing was held for Petitioner on May 27, 2026, at which Petitioner was granted bond in the amount of $15,000. (ECF No. 11 at 1.)
